1. Agreement to Terms

These Terms and Conditions (the "Terms") are a legally binding agreement between you and Mixzy Indrajaya, doing business as HSKTOCFL.online ("we," "us," or "our"), regarding your access to and use of https://hsktocfl.online and related learning features (the "Services").

By accessing or using the Services, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must stop using the Services.

If you are under the age of majority in your jurisdiction, you may use the Services only with permission and supervision from a parent or legal guardian.

2. Our Services

HSKTOCFL.online is an online Chinese language-learning platform that provides HSK and TOCFL vocabulary courses, quizzes, reading practice, educational games, progress tracking, and leaderboard features.

The Services are intended for personal learning use. They are not intended as official testing, certification, immigration, academic, legal, or professional advice.

3. Accounts and Access

Some parts of the Services require member access. You may be required to sign in using a Google account associated with an approved buyer email address.

You are responsible for keeping your login credentials and account access secure. You must not share, sell, rent, transfer, or allow another person to use your account, login credentials, course access, or member features.

We may suspend or remove access if we believe an account is being misused, shared, transferred, used to bypass access controls, used to cheat, or used in a way that harms the Services or other users.

4. Purchases and Payments

We sell digital goods and services, including access to online course content and member-only learning features. Payments are handled through Lynk.id or another payment provider shown during checkout.

Payments are generally made in Indonesian Rupiah (IDR). The exact price, package, and access period are shown on the relevant sales page, checkout page, or buyer communication.

Unless a product page clearly says otherwise, purchases are one-time purchases for the stated access period. They do not automatically renew. If your access expires, you may need to manually purchase or renew access again.

After payment verification, access may be granted to the Gmail address connected to the purchase. It is your responsibility to provide the correct Gmail address for access.

5. Returns and Refunds

Because the Services provide digital course access and online learning features, purchased access cannot be physically returned.

Unless required by applicable law or separately agreed by us in writing, payments for digital access are generally non-refundable once access has been granted or made available.

If you believe there was a duplicate payment, access error, technical issue, or payment verification problem, contact us at chinese@hsktocfl.online. We may review issues case by case.

6. User Rules and Prohibited Activities

You agree not to use the Services for unlawful, abusive, harmful, or unauthorized purposes. You also agree not to:

• Use the Services to advertise, promote, or offer goods or services without permission.
• Sell, transfer, rent, lend, or share your profile, course access, login credentials, or member account.
• Cheat, manipulate, abuse, or interfere with quizzes, games, leaderboards, access controls, or platform security.
• Copy, scrape, redistribute, publish, resell, or commercially reuse course content, vocabulary data, quizzes, game content, website materials, or other Service content without permission.
• Reverse engineer, bypass, disable, or interfere with authentication, member guards, payment verification, or other access restrictions.
• Upload, send, or introduce viruses, malicious code, automated bots, scraping tools, or harmful scripts.
• Attempt to access another user's account, progress, scores, buyer record, or private information.
• Use the Services in a way that damages, overloads, or disrupts the website, databases, backend systems, or other users' experience.

7. Content and Intellectual Property

The website design, text, course structure, quizzes, learning flows, game systems, visual elements, and other materials provided through the Services are owned by us or licensed to us, unless stated otherwise.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own learning purposes during your access period.

You do not receive ownership rights in the Services or our content. You may not copy, resell, redistribute, republish, or commercially exploit the Services or content without our written permission.

8. Progress, Scores, and Leaderboards

The Services may save learning progress, quiz results, game results, scores, play counts, and leaderboard information.

Leaderboard features may publicly display limited user identity information, such as a partial email/name, score, rank, or related game statistics. Do not use leaderboard features if you do not want this limited display.

We may remove, adjust, or reset scores, rankings, progress, or leaderboard entries that appear incorrect, abusive, manipulated, or connected to cheating or technical errors.

9. Third-Party Services

The Services may rely on third-party providers, including Google/Firebase for login, backend, database, security, and related technical services; Hostinger for website hosting; Lynk.id for payment processing; and Termly for legal policy tools.

Third-party services may have their own terms, privacy policies, and processing rules. We are not responsible for third-party websites or services that we do not control.

10. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, store, and share personal information.

11. Service Availability and Changes

We try to keep the Services available and working, but we do not guarantee that the Services will always be uninterrupted, error-free, secure, or available at every time or location.

We may update, modify, pause, restrict, replace, or discontinue parts of the Services, including courses, games, features, access methods, and user interface elements. We may also remove old features or related data when replacing or retiring features.

12. Limitation of Liability

To the maximum extent permitted by applicable law, our liability for any claim related to the Services will be limited to the lesser of: (a) the amount you paid for the relevant Service giving rise to the claim, or (b) IDR 500,000.

Any claim related to the Services must be brought within six (6) months after the event giving rise to the claim, unless a longer period is required by applicable law.

We are not responsible for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data; loss of access; lost profits; or issues caused by third-party services, user device problems, internet connectivity, or misuse of the Services.

13. Dispute Resolution

If you have a concern or dispute, you agree to contact us first at chinese@hsktocfl.online and try to resolve the issue informally.

Both parties agree to attempt informal negotiation for at least 30 days before starting formal proceedings. If the dispute cannot be resolved informally, it will be resolved through arbitration in Indonesia, unless applicable law requires another process.

14. Changes to These Terms

We may update these Terms from time to time. For material changes, we aim to provide notice before the updated Terms become effective. Security updates, bug fixes, changes required by a court order, or urgent operational changes may take effect immediately.

The updated version will be indicated by the "Last updated" date above. Continued use of the Services after changes become effective means you accept the updated Terms.
